A configuração da Justiça
Resumo
Estudos e pesquisas sobre uma grande variedade de conexões literário-linguísticas da lei e sobre as ciências humanas aumentaram enormemente o escopo da teoria legal nas últimas décadas. Entretanto, neste artigo defendo a união de teoria e prática no direito e jurisprudência quando nos voltamos para as ciências humanas para nossos empreendimentos interdisciplinares, na visão de que a ideia (1) original dos estudos jurídico-literários era ajudar a nutrir o professional do direito. Isto é especialmente emergente porque, pelo menos para mim, é através da lei na prática que podemos aprender a falar de justiça. Então, a questão quid-juris que está no coração da doutrina do direito e da jurisprudência tradicionalmente concebida, permanence importante quando se investiga as possibilidades da contribuição das ciências humanas no plano metodológico. Em outras palavras, enquanto discutimos questões de justiça de forma abstrata, somente na maneira pela qual questões legais reais são resolvidas que podemos decidir que a justiça esteja sendo feita. Não podemos, então, pensar na justiça sem a lei na prática, porque significado legal e justiça são os produtos de discussões sobre como estabelecer relações sociais e legais concretas. Isto chama a atenção de como a lei é e pode ser feita. Meu objetivo é me voltar às hermeneuticas filosóficas continental-europeias, especialmente como desenvolvidas por Paul Ricoeur, muito ricas nas questões de metáforas, sabedoria prática e o que é justo, para desenvolver meu argumento principal e oferecer sugestões para Law and Literature in practice através das lentes do studia humanitis.
